1. RULES
These are the official rules that govern how the Fan Experience From Corning Gorilla® Glass & Imagine Dragons promotion (the “Contest”) will operate. In these rules, "Corning", "we", "our", and "us" refers to Corning Incorporated. "You," "yourself" refers to an eligible Contest entrant. “The Promoter” is Corning Incorporated, One Riverfront Plaza, Corning, New York, 14831, United States (“Corning”).
2. ELIGIBILITY
The Contest is open to legal residents who are physically located in India, who are 21 years of age or older, and who have a valid passport and meet US travel visa requirements at the time of entry. Proof of age, identity, possession of a valid passport, and place of residence may be required. If selected as a Grand Prize winner, to receive the prize, you are required to obtain a US visa at your own expense, and possess a valid credit card that can be used in the United States to secure against incidental hotel expenses which are not part of the Grand Prize. Employees of Corning Incorporated (“Corning” or “Sponsor”) employees of Corning Technologies India Private Limited, Imagine Dragons, Tyler Robinson Foundation, Inc., Paradigm Talent Agency, Doremus & Co., FleishmanHillard (“Fleishman”), and GMR Marketing LLC (“GMR”), and any promotion or other vendor agencies involved in this Contest (and any other person engaged to work on this Contest) and any agents acting for, or on behalf of, the above entities, their respective parent, subsidiary and related companies, officers, directors, affiliates and service providers (collectively, the “Released Parties”) and the immediate household members, whether related or not, and immediate family members (defined for the purposes of this Contest as a parent, spouse, child, and sibling) of such employees are NOT eligible to enter or win. Contest is subject to all national and local laws and regulations and is void where prohibited by law.
In organizing the Contest, Promoter does not intend to promote its products, trademarks, or services, but rather Promoter is seeking feedback from the entrants through this contest in order to improve its products/services and provide better experience to its customers.
3. ACCEPTANCE
By entering into Contest, you accept fully and unconditionally these Terms and Conditions and you agree to be bound by them.
4. CONTEST PERIOD
This Contest runs from 12:01 a.m. India Standard Time (“IST”) on September 5, 2018 and closes 11:59 p.m. IST on September 14, 2018 inclusive (the “Contest Period”). Entries received outside of the Contest Period will not be valid.
5. HOW TO ENTER:
To enter the Contest, you must register and submit an entry during the Contest Period as follows:
1) Visit https://www.asecondevolution.com/in (the “Website”) during the Contest Period;
2) Discover or decode the passwords to all six (6) puzzles shared on social media by Imagine Dragons and Corning;
3) Input the correct passwords in each of the six (6) designated password fields and click the “Submit Button” next to each password field that aligns with the numbered password field, once all six (6) correct passwords are entered;
4) Check the box to confirm your eligibility, and to accept these Official Rules and the Corning Privacy Policy;
5) Complete the Official Online Entry Form including your full legal name; your full shipping address including your street address, city, province, and postal code; mobile phone number; and email address, and click the “Submit” button;
6) To earn an entry, you must (1) input an essay of no more than 800 characters, written in English, responding to the following topic: “Explain why attending the Las Vegas Imagine Dragons fan experience in the United States is important to you” (the “Essay”), as instructed on the Website;
7) Click “Submit” (an “Entry”).
Your Essay and all entry information you submit shall be referred to collectively as your “Submission.”
A. How to Receive Hints to Help Decode Puzzles:
1) Receive a Hint Via Twitter: If you submit an incorrect password in any designated field on the Website, a pop-up will appear noting the entered password is incorrect and offering you an option to request a hint via Twitter for the incorrect password you submitted. A pre-populated Twitter message will appear. To initiate the Twitter message, you must click the available Twitter login button, sign into your Twitter account, and post the message. The Sponsor and Imagine Dragons will provide up to two (2) hints via Twitter for each of the six (6) puzzles, and reserves the right to provide fewer or additional hints at their sole discretion.
a. Twitter Criteria and Terms: Twitter messages must be made by the authorized Twitter account holder during the Contest Period. “Authorized Twitter account holder” is deemed as the natural person who is assigned to the Twitter address from which the message is sent. If your Twitter account is private, you must change the setting on your account from private to “public” or “unprotected” in order to receive a hint via Twitter. You must have a valid Twitter account and agree to the Twitter Terms of Use and the Twitter Privacy Policy in order to request a hint via Twitter. Registration on Twitter must be completed before a hint request may be submitted. Twitter membership is free. Twitter messages that contain information that is deemed to be lewd or profane; contain material that violates or infringes on another’s rights, including privacy, publicity, or intellectual property; material that is hateful or defamatory; material that promotes bigotry, racism, or harm against a group or individual or promotes discrimination; or material that is unlawful or in violation of or contrary to the laws or regulations in any state, will be disqualified as determined solely by Sponsor.
2) View Available Hints: After a hint is provided to any eligible entrant, through the process described in Section 5. B. 1) (a “Published Hint”), the Published Hint will be available for viewing at http://www.corning.com/gorillaglass/in/en/hints.html. All Published Hints will be available for the duration of the Contest Period.
B. Limit one (1) Entry per person during the Contest Period. Entry is not available prior to the Contest Period. Entries received from any person in excess of stated limitations or otherwise not in compliance with the foregoing will be void and those involved in such submissions will be disqualified.
6. ADDITIONAL CRITERIA FOR ENTRY
Entry essay must be written in English and must be entrant’s original creation and must not include material that infringes any third person’s copyrights or trademarks, has previously been published or has previously been submitted in substantially the same form in any other contest, or names or identifies any individual other than the entrant and/or his/her child or legal ward, or members of Imagine Dragons. Entrants have a limited license to reference or quote Imagine Dragons’ song titles, lyrics, and album names, for the sole purpose of writing this essay. Submission must conform to local law, and must not defame or invade the rights or privacy of any person, or otherwise infringe upon any third party’s personal, proprietary or intellectual rights. Submission must be consistent with the Sponsor’s and Imagine Dragons’ brand reputations in the marketplace and must be suitable for audiences of all ages. Entry essay must not include or involve any of the following: obscenity, crude, vulgar or offensive language; violence, explicit sexual language; phone numbers, personal addresses (physical or email or otherwise); website or web page links or links to apps; derogatory characterizations of any ethnic, racial, sexual or religious groups or content that would humiliate other people (publicly or otherwise), any assault or threatening of others, or material that advertises the goods or services of entrant or material that includes any paid third party advertising. Submissions must adhere both in appearance and in fact to the norms of civil discourse. Submissions containing any of the foregoing content or otherwise in violation of these Official Rules, or containing any other content, display, materials and/or images that are or could be considered objectionable or infringing, inappropriate, unsuitable or offensive, as determined by Sponsor in its sole discretion, will be disqualified. Once an entry is submitted, it is considered a final submission and may not be modified, edited, or replaced.
7. JUDGING AND SELECTION OF WINNERS:
This is not a game of chance. All Essays will be judged on a 100-point scale by the Contest Administrators. Entries will be evaluated, and up to 100 points awarded, using the following criteria:
1) A maximum of 40 points for overall Strength in Reason for attending the Fan Experience. Which is defined as level of rationale and desirability for reason.
2) A maximum of 30 points for Creativity. Which is defined as originality and uniqueness.
3) A maximum of 30 points for Passion. Which is defined as expressing your excitement and overall fan passion for Imagine Dragons.
The top five (5) eligible entrants who submitted Entries that earn the highest scores will be designated as potential Grand Prize winners. In the event of a tie, the Entry with the highest total in the Strength in Reason for attending the Fan Experience category will be deemed a potential Grand Prize winner. If the entries still remain tied, a qualified judge from Corning will select the Entry they feel best represents the overall themes of the Contest.
Sponsor reserves the right to select fewer than five (5) Grand Prize winners if a sufficient number of quality, eligible Entries are not received, or if potential winners are ineligible or fail to follow the required steps (see Section 8) in the required time.
8. GRAND PRIZE WINNERS NOTIFICATION:
The potential Grand Prize winners will be notified by phone, email, and/or express mail, on or about September 19, 2018. Each potential Grand Prize winner must respond to GMR/Fleishman via phone within twenty-four (24) hours of first attempted notification or the Grand Prize will be forfeited and may be awarded to an alternate winner, time permitting. Sponsor is not responsible for suspended or discontinued wireless or online service, change in any entrant’s street address, email address, or mobile phone number which may result in a potential Grand Prize winner not receiving initial prize notification.
Each Grand Prize winner must complete, sign, and return to Sponsor/GMR/Fleishman within seven (7) calendar days of date of receipt all of the following as requested by Sponsor: (1) a Grant of Rights consistent with the provisions of these Rules; (2) a publicity release consistent with the provisions of these Rules; (3) an affidavit of eligibility; (4) a mutually-acceptable liability release; and (5) an Assignment of Rights, and (6) a copy of the winner’s Permanent Account (PAN) card (the “Documents”), or the prize will be forfeited in its entirety.
If any attempted notification is returned as undeliverable, if a notified potential Grand Prize winner doesn’t respond within the designated time frame, if any required Documents are not returned within the required time frame, if any potential Grand Prize winner cannot be verified or found, if any Grand Prize winner is unable to travel during required designated travel dates, or if any Grand Prize winner is otherwise unable to accept the prize as stated, Sponsor will declare the prize forfeited, and the Entrant with the next highest score may be deemed an alternate potential Grand Prize winner, time permitting. Notification time line for any alternate potential Grand Prize winner may be adjusted, time permitting.
9. GRANT OF RIGHTS:
Grand Prize winners grant to Sponsor and Sponsor’s designees, Imagine Dragons and Imagine Dragons’ designees, including Interscope Records, a royalty-free, sub-licensable, transferable right to exploit the copyright in his/her Entry, and any ancillary and subsidiary rights therein, in any medium through the world in perpetuity for editorial, educational, promotional, publicity, or advertising purposes, including without limitation the right to edit, publish, use, adapt, exploit, modify, copy, disseminate, or dispose of the Entry without further compensation or notification of any kind (the “License”) except as prohibited by law. Grand Prize winners shall execute at Sponsor’s request such documents as may be necessary to confirm or enact the grant of rights set forth herein.
10. PUBLICITY RELEASE:
Each Grand Prize winner grants to Sponsor and Sponsor’s designees, Imagine Dragons and Imagine Dragons’ designees, including Interscope Records, the right to the use of Grand Prize winner’s name, picture, likeness, voice, video, biographical information and statements, at any time or times, for advertising, trade, publicity and promotional purposes or for any other reason Sponsor sees fit, without limitation, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without additional notice, consent, review or approval, and without additional compensation, unless prohibited by law.
11. USE OF YOUR SUBMISSION AND ASSIGNMENT OF RIGHTS:
By submitting your Entry, you:
a) are granting the Released Parties an irrevocable, worldwide, royalty-free, perpetual right and license for the duration of the protection of the copyrights to: (i) reproduce, copy, modify or alter your Submission with all known or later developed means in connection with the promotion of this Contest in all media (now known or later developed); (ii) use, review, assess, test and otherwise analyze your Submission and all its content in connection with this Contest; and (ii) feature your Submission and all its content in connection with the promotion of this Contest in all media (now known or later developed);
b) except where prohibited by applicable law, hereby irrevocably and unconditionally waive in perpetuity any and all so-called “moral rights” or any similar right that you may have or hereinafter acquire in the Submission and all its content, and to the extent that you cannot, you hereby consent to us doing or omitting to do any act that would otherwise infringe such “moral rights” or any such similar rights;
c) agree to sign any necessary documentation that may be required for the Released Parties and their designees to make use of the rights you granted above;
d) understand and acknowledge that the Released Parties and other entrants may have developed or commissioned materials similar or identical to your submission and you waive any claims you may have resulting from any similarities to your Submission;
e) understand that the Released Parties cannot control the incoming information you will disclose to the Released Parties’ representatives in the course of entering, or what the Released Parties’ representatives will remember about your Submission. You also understand that the Released Parties will not restrict work assignments of representatives who have had access to your Submission. Except where prohibited by applicable law, by entering this Contest, you agree that use of information in the Released Parties’ representatives’ unaided memories in the development or deployment of the Released Parties’ products or services does not create liability for the Released Parties under this agreement or copyright or trade secret law;
f) understand that you will not receive any compensation or credit for use of your Submission, other than what is described in these Official Rules;
g) agree that you have no right to use the copyrights, trademarks, or other intellectual property relating to the Designated Cars outside the Contest.
Please note that following the end of this Contest your Submission may be posted on a website selected by the Released Parties for viewing by visitors to that website. The Released Parties are not responsible for any unauthorized use of your Submission by visitors to this website. While the Released Parties reserve these rights, the Released Parties are not obligated to use your Submission for any purpose, even if it has been selected as a winning Submission.
If you do not want to grant the Released Parties these rights to your Submission, please do not enter this Contest.
12. PRIZES:
Five (5) Grand Prizes: A trip for the Grand Prize winner to Las Vegas, Nevada, United States during dates of the Sponsor’s discretion between November 3, 2018 and November 10, 2018 to attend ‘The Fan Experience from Corning Gorilla® Glass & Imagine Dragons’ (the “Event”).
Grand Prize includes: Round trip coach-class airfare for the Grand Prize winner to Las Vegas, Nevada, United States from an airport near the winner’s home determined at the sole discretion of the Sponsor; two (2) nights’ hotel accommodations in Las Vegas, Nevada, United States (hotel to be determined at the sole discretion of the Sponsor, excluding room service, meals, and other incidentals); ground transportation to and from McCarran International Airport/hotel and, if applicable, between the hotel and event venue; one (1) $300 US Dollar bank card; and admission for the Grand Prize winner to attend ‘The Fan Experience From Corning Gorilla® Glass and Imagine Dragons’ (all aspects of the event, including date and seat location, are at the sole discretion of the Sponsor). The Approximate Retail Value (“ARV”) of each Grand Prize is: ₹286,476. The value of the prize includes applicable tax.
The total ARV of all Grand Prizes, including applicable tax, is ₹1,432,380.
Travel route, air carriers, hotel accommodations, ground transportation vendors, and all elements of the Grand Prize will be determined by the Sponsor/GMR in their sole discretion. Airline carrier’s regulations and conditions may apply. Grand Prize travel may not be combined with any other offer and travel may not qualify for frequent flyer miles. Each Grand Prize winner must possess any necessary valid travel documents (i.e., valid passport) and obtain, at his or her own expense, a US travel visa in order to travel. Airline seat selection and timing of trip are subject to availability and confirmation of reservation and any charges incurred in addition to initial travel booking are winner’s sole responsibility. The Released Parties are not responsible for changes in schedule of any element of the Grand Prize and the Released Parties are not liable for any expenses incurred as a consequence of flight cancellation/delay. Any change made by any Grand Prize winner to the travel itinerary, including any cost implications, is the Grand Prize winner’s sole responsibility. No refunds or credit for changes are allowed. All other expenses and costs, not expressly listed above, including, but not limited to national, provincial and local taxes, tips, entertainment, transfers, travel insurance, personal expenses, and transportation to and from each Grand Prize winner’s home residence are each Grand Prize winner’s sole responsibility.
Grand Prize winners will be required by hotel to provide a valid credit card to secure against incidental expenses. Grand Prize winners must comply with all Fan Experience venue rules and regulations as well as all instructions issued by Imagine Dragons and their designees; failure to do so may result in forfeiture of such portions of the Grand Prize.
These are estimated values only. The actual value of the Grand Prize is expected to vary, based on the point of origination, airfare fluctuations, and hotel pricing. If the actual value of the travel portion of prize is less than stated, difference will not be awarded in cash, and no such claim will be honoured.
The Grand Prize winners must plan trip with Sponsor/GMR and travel must occur on dates designated by the Sponsor between November 3, 2018 and November 10, 2018, or the Grand Prize winner shall forfeit the prize in its entirety and an alternate winner may be selected, time permitting. Dates of departure and return, travel route, seat selection, hotel accommodations, activities, and all elements of the Grand Prize will be arranged by the Sponsor/GMR, in their sole discretion, and are subject to availability and/or change.
Prizes are not redeemable for cash. No substitution, transfer, or assignment of prize permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value. All other expenses not specified as part of prize description are solely the Grand Prize winner’s responsibility.
The Sponsor will bear the tax liability on the prizes awarded in the Contest.
Sponsor is not responsible for any problems related to the shipping of any prize, including, but not limited to, theft, delay, damage, or destruction/accidental loss by the shipping carrier.
13. ADDITIONAL TERMS:
If for any reason the Contest is not capable of running as planned, including but not limited to fire, flood, epidemic, earthquake, explosion, labour dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, disruptions caused by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause that corrupts, affects or compromises the administration, security, fairness, integrity, proper conduct or intended play of the Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest, and select the potential Grand Prize winners from among all eligible, non-suspect entries received up to that time. Sponsor also reserves the right to disqualify any individual whom Sponsor or GMR deems responsible for or related to actual or attempted disruption of or interference with the Contest or its intended operation. Sponsor assumes no responsibility for any error (including user error), omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, lost, failed, incomplete, inaccurate, stolen, misdirected, undelivered, garbled, destruction or unauthorized access to, or alteration of, entries, including any erroneous appearance of qualification for a prize. In no case will more than the stated number of prizes be awarded. Sponsor is not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, servers or Internet Service Provider (ISP), computer equipment, satellite, telephone or cable transmissions, software, failure of any e-mail or Entry to be received by Sponsor due to technical problem or traffic, congestion on the internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest. WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
14. INDEMNIFICATION AND RELEASE OF LIABILITY:
By entering, entrant agrees to accept and abide by the Official Rules of this Contest and agrees that any questions with regard to the conduct of this Contest, interpretation of the Official Rules or awarding of a prize shall be resolved by Sponsor or GMR whose decision shall be binding and final. By entering, entrant agrees to release, indemnify and hold harmless the Released Parties and Twitter, Inc. from any injury, loss, or damage to person or property, including without limitation bodily injury, death, loss of privacy, breach of security, loss of control of devices/appliances, or any other harm due in whole or in part, directly or indirectly, to the acceptance, use, or misuse of a prize, or participation in any Contest-related activity. By entering, entrant agrees to be contacted using the information provided to the Sponsor and/or GMR during entry for the purposes of Contest administration. Sponsor is not responsible for any typographical or other error in the printing of this offer, administration of the Contest, the disqualification or elimination of any entries for any reason, or in the announcement of prizes, including such error as an erroneous indication that a prize has been won. All entries are the property of Sponsor and are not returnable.
THE RELEASE DOES NOT APPLY TO PERSONAL INJURIES, DEATH, DAMAGES, OR LOSSES CAUSED BY RELEASED PARTIES’ INTENTIONAL OR GROSS NEGLIGENCE, OR FRAUDULENT REPRESENTATION.
15. USE OF DATA:
Any personal data relating to entrants, winners will be used solely in accordance with Corning’s Privacy Policy, which is located at http://www.corning.com/gorillaglass/worldwide/en/global-data-protection-policy.html. Please note that by entering, you are accepting these Official Rules and the terms of the Privacy Policy.
Entrants’, winners’ personal data will be used by the Released Parties and their representatives, employees, or third-party vendors for the use and purposes to execute and administer the Promotion as provided in and in connection with these Official Rules. Entrants have the right to access, withdraw, and correct their personal data and under certain circumstances to oppose the collection or processing of the information and request the status of Sponsor’s use or sharing of personal information. Entrants may request such action by contacting Sponsor. To exercise these rights, entrants may write to privacy@corning.com. The personal data will be stored by Sponsor on servers located within the United States.
Data may be transferred or otherwise provided to third parties for the purpose of running and administering the Contest. As reasonable and appropriate, these entities will be required to sign confidentiality agreements to safeguard the integrity of the entrant’s personal information.
16. GOVERNING LAW:
All disputes concerning the construction, interpretation, validity, effect, and enforceability of these Official Rules will be governed by the laws of the state of New York without regard to conflicts of laws provisions. Entrant (i) agrees that exclusive jurisdiction over any legal action arising out of or in connection with the Contest will be in state or federal courts located in or nearest to state of New York, and by entering consents to such jurisdiction and venue; (ii) consents to resolve any such claims individually and without resort to class action; and (iii) agrees that all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event will attorney’s fees or punitive, incidental, consequential, or any damages other than actual out-of-pocket expenses be awarded.
17. OTHER:
No correspondence will be entered into regarding either this Contest or these Terms and Conditions. In the event of a dispute, The Promoter’s decision shall be final in all respects on all entrants. The Promoter reserves the right to amend, modify, cancel or withdraw this Contest and to amend these Terms and Conditions at any time.
