Program Description: The presentation will begin with an overview of administrative proceedings before the International Trade Commission (“ITC”) under section 337 of the Tariff Act and how these can be used to obtain relief from imports that violate U.S. intellectual property rights. This will be followed by a discussion of the types of remedies available in the ITC and, in particular, how the ITC’s long standing practice of granting limited exclusion orders that cover downstream products manufactured by non-parties was recently repudiated by the Federal Circuit in Kyocera Wireless Corp. v. International Trade Commission, 545 F.3rd 1340 (Fed. Cir. 2008). The presentation will conclude with a discussion of the ITC’s response to Kyocera and how the decision is likely to affect parties appearing before the ITC.
